Özet

Osmanlı Devleti’nin son devri sayılan Tanzimat’a kadar, dinî ilimler yanında pozitif bilimlere de ağırlık veren medreseler, fıkıh eğitimi sisteminin omurgasını teşkil etmiştir. Daha çok Fıkıh (jurisprudence) eğitimi merkezi özelliği taşıyan medreselerde, istihdam da genellikle eğitim ve adalet mesleklerinde yapılmıştır. Tanzimat’tan sonra ise kendini yeniden tanımlayan devlet, eski sistemde oluşan boşlukları, Avrupa medeniyetinin ürünü kurum ve kuruluşlarla doldurmaya başlamıştır. Bu durum hukuki ve adli sahada büyük oranda kırılmalar yaşanmasına sebep olmuş, çeşitli sebeplerle liyakat ve mülazemet sistemi bozulan medreseleri hem eğitim hem kurumsal açıdan nitelik olarak oldukça zayıflatmıştır. Netice olarak medreseleri yeniden ihya etmek için özellikle II. Meşrutiyet’ten sonra medreselerde de bazı başarılı ıslahat girişimleri olmuştur. Makalenin amacı gerçekleştirilen bu başarılı ıslahat çalışmalarında ve yeni açılan medreselerde fıkıh eğitimini incelemek ve elde edilen neticeyi tartışmaktadır. Bu anlamda önce Osmanlı Devleti’nde bir ilk olma özelliği taşıyan ve Tanzimat Dönemi’nden sonra açılan hususi medreselere değinilecektir. Bu hususi medreseler yeni oluşan ihtiyaçlar göz önünde bulundurularak fıkıh ve irşad alanlarında açılmıştır. Daha sonra nitelik açısından zayıflayan geleneksel Osmanlı medreselerinde yapılan ıslahat çalışmaları ve nizamnamelerden bahsedilecektir. Araştırmada “tarihi araştırma yöntemi” kullanılmıştır. Bu yöntemle araştırmanın konusunu oluşturan dönem eleştirel bir gözle incelenip, doğru bir şekilde tahlil edilmeye gayret edilmiştir. Anahtar Kelimeler: Medrese, Islahat, Fıkıh, Tanzimat, Eğitim. 

Until the Tanzimat, which is considered to be the last period of the Ottoman Empire, madrasahs, which focused on positive sciences as well as religious sciences, formed the backbone of the fiqh education system. In madrasahs, which are mostly a fiqh (jurisprudence) training center, employment was generally carried out in education and justice professions. The state, which redefined itself after the Tanzimat, started to fill the gaps in the old system with institutions and organizations that were the products of European civilization. This situation caused major breakdowns in the legal and judicial field, and the madrasahs, whose merit and mulazemet system were disrupted for various reasons, weakened both in terms of education and institutional aspects. As a result, in order to revive madrasahs, especially II. After the Constitutional Monarchy, there were some successful reform attempts in madrasas. The aim of the article is to examine fiqh education in these successful reform studies and newly opened madrasahs and discuss the results obtained. In this sense, first of all, special madrasahs, which are the first in the Ottoman Empire and opened after the Tanzimat Period, will be mentioned. These special madrasas were opened in the fields of fiqh and irshad, taking into account the newly emerging needs. Later, the reforms and regulations of traditional Ottoman madrasahs that have weakened in terms of quality will be mentioned. "Historical research method" was used in the research. With this method, the period that constitutes the subject of the study has been critically examined and tried to be analyzed correctly. Keywords: Madrasah, Islahat, Fiqh, Tanzimat, Education.
