1982 Anayasasına göre seçimler yargı yönetim ve denetiminde yapılır. Bu
yargı organları; Yüksek Seçim Kurulu, il seçim kurulları ve ilçe seçim kurullarıdır.
298 sayılı kanuna göre il seçim
kurulu, il merkezinde görev yapan en kıdemli hakimin başkanlığında, merkez ilçe
seçim kurulu başkanından sonra gelen en kıdemli iki hakimden oluşur.
Seçim kanunlarıyla ilgili yapılan
değişiklik çalışmalarından basına yansıyan bilgilerden il seçim kurulunun
oluşumu ile değişikliğe gidildiği anlaşılmaktadır. Buna göre il seçim kurulu
üyelerinin Yüksek Seçim Kurulu tarafından atanması öngörülmektedir. Tasarı
olarak somutlaşmayan bu düzenlemeye bir takım eleştiriler getirilse de bu
düzenleme, seçim kurullarının
devamlılığını ve uzmanlaşmasını sağlayacak olması sebebiyle yerinde ve
gereklidir.
Seçim kurullarının seçimlerin
yönetim ve denetim görevi, kendine has süreçleri barındıran ve uzmanlık
gerektiren bir bakış açısını zorunlu kılmaktadır. Kanun koyucu, il seçim kurulu
üyeliğinde niteliği arttırmak amacıyla 2005 yılında değişikliğe gitmiştir. Buna
göre illerde en kıdemli hakimin belirlenmesinde devlet memurluğu kıdemi değil
hakimlik kıdemi esas alınmaktadır. Fakat
il seçim kurulu üyelerinin sadece hakimlik kıdemine göre belirlenmesi de seçim
kurullarının kendi alanında uzmanlaşmasını zorlaştırmaktadır.
İl seçim kurulu üyelerinin Yüksek
Seçim Kurulu tarafından atanmasıyla, seçim kurullarının işleyişinde daha
sağlıklı bir süreç gelişeceği değerlendirilmektedir. Fakat değişikliğin bu
amaca hizmet etmesini sağlamak, kamuoyunda oluşabilecek eleştiri ve çekinceleri
bertaraf etmesi amacıyla ilave düzenlemelerin yapılması düşünülmelidir. İl
seçim kurulu üyelerinin atanması ve görevden alınmasına yönelik ilave
güvenceler, il seçim kurulu üyesi seçilmek için asgari hakimlik kıdemi şartı,
il seçim kurulu üyesi seçilmek için belirli bir süre ilçe seçim kurulu üyeliği
yapma şartı, il seçim kurulu üyeliğinin hakimler açısından tercih edilebilir
olmasını sağlayacak diğer düzenlemeler, bu çerçevede değerlendirilmelidir.
According to the 1982 Constitution, elections are
held under judicial administration and control. These judicial bodies are
Supreme Election Council, provincial
election board and district election boards. According to the
Law No. 298 on Basic Provisions of Elections and Voter Registers, the
provincial election board composed of two senior members of district election board
after president and headed by the eldest judge serving in the central district.
It is understood from the information reflected in
the press of the amendment studies regarding the election laws, that the
changes includes the formation of the provincial election board. Accordingly,
it is envisaged that the members of the provincial election board will be
appointed by the Supreme Election Council. Although some criticisms are brought to this
regulation, which is not embodied as a draft, this regulation is appropriate
and necessary as it will ensure the continuity and specialization of the
election boards.
The administration
and control duties of election boards necessitate a
perspective that includes unique processes and requires expertise. The
legislator made changes in 2005 in order to increase the quality of the
provincial election board membership. Accordingly, the determination of the
most senior judge in the provinces is based on the seniority of the judge, not
the civil service seniority. However, the determination of provincial election
board members only based on the seniority of judges also makes it difficult for
election boards to specialize in their own field.
It is considered that a healthier process will
develop in the functioning of the election boards with the appointment of the
members of the provincial election boards by the Supreme Election Council. However, additional arrangements should be
considered in order to ensure that the change serves this purpose and to
eliminate the criticism and reservations that may occur in the public. Additional guarantees for the appointment and
dismissal of provincial election board members, the
minimum judge seniority requirement to be elected as a provincial election
board, to be elected as a member of the provincial election
board the condition of being a member of the district election board for a
certain period of time, other regulations that will ensure that membership
of the provincial election board is preferable to judges,should be evaluated
within this framework.
